Terms of Service

These Terms of Service ("Terms") govern your use of Permafrost EPM ("the Service"), operated by DuneCodeForge Ltd ("Permafrost," "we," "us"), a company incorporated in the United Arab Emirates. By creating an account or signing in, you agree to these Terms.

1. The Service

Permafrost is a Cloud Infrastructure Entitlement Management (CIEM) product that analyzes identity and permission state across Microsoft cloud surfaces. The Service is read-only against your tenant. It is offered as a single edition, Professional, billed by usage.

2. Acceptable use

You agree not to:

  • Use the Service to analyze any tenant for which you do not have explicit administrative authority
  • Attempt to probe, scan, or test the vulnerability of the Service or to circumvent its access controls
  • Use the Service to interfere with or disrupt the integrity or performance of any Microsoft cloud or any other third-party service
  • Reverse-engineer, decompile, or attempt to derive source code from the Service
  • Resell or sublicense the Service without our written consent

3. Free trial

Professional Edition is offered with a 30-day free trial that requires no payment card. During the trial you have full access to the Service. When the trial ends, add a payment method to continue on the metered Professional plan; if you do not, your account enters the closure and deletion process in Section 5. We no longer offer a free "Community" edition; any account previously on that tier is moved to a Professional trial.

4. Subscription and billing

Professional Edition is billed by usage. The current per-identity unit prices, included limits, and retention windows are published at permafrostepm.com/pricing and are incorporated into these Terms by reference. Usage is billed monthly in arrears via Stripe: identity counts are measured from daily records, and an identity counts toward a month only if it was enabled on at least 10 calendar days of that month. Groups are never counted, and Microsoft first-party service principals are excluded.

New accounts begin with a 30-day Professional Edition trial. Accounts that were previously on the legacy Community tier have been moved to a Professional Edition trial of the same length. When a trial ends without an active subscription, the account reverts to Permafrost's included free allowance (the privileged-identity set, up to the included object count); coverage beyond that allowance pauses until a Professional Edition subscription is started. Your tenant data and history are retained, and a later subscription restores full coverage on the next sync.

Failed payments may result in suspension of sync and dashboard access. We will notify you by email before any service interruption.

5. Cancellation, suspension, and deletion

You may cancel your subscription at any time through the Stripe Customer Portal accessible from the dashboard. Cancellation takes effect at the end of the current billing period; usage already consumed is non-refundable.

When your subscription ends — whether by cancellation, by a trial expiring without a payment method, or by non-payment — your access to the Service stops and your account enters a 30-day deletion window. During that window you cannot use the Service, export your data, or run any reports. Within the window you may restore access by starting a Professional trial or adding a payment method. If you take no action, all customer-scoped data is permanently deleted at the end of the 30 days — except the billing, tax, and deletion-audit records described in our Privacy Policy.

If you want your data removed sooner, you may request immediate deletion at any time. We will action the request and email you to confirm once it is complete.

6. Intellectual property

You retain all rights to your tenant data. Permafrost retains all rights to the Service, including the analysis logic, the generated findings, and the recommended-role outputs. You may use those outputs internally without restriction.

7. Warranty disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PERMAFROST IS A READ-ONLY ANALYSIS TOOL; YOU REMAIN RESPONSIBLE FOR ALL CONFIGURATION CHANGES TO YOUR AZURE TENANT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PERMAFROST'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO PERMAFROST IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL PERMAFROST BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9. Governing law

These Terms are governed by the laws of the United Arab Emirates, including Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (the UAE PDPL), without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of the Emirate in which DuneCodeForge Ltd is registered, United Arab Emirates. This does not deprive you of any mandatory consumer- protection rights you may have under the law of your country of residence.

10. Changes to these terms

We may update these Terms from time to time. Material changes will be announced by email and via an in-app banner at least 30 days before taking effect.
